For some people, their only hope of having a child is with the aid of gametes obtained from a donor. These altruistic people make it possible for others to fulfil their dreams of parenthood. The decision to have children or to help someone have children with the aid of donated eggs or sperm is a complex lifelong decision. There are many factors that need to be considered, including potential long term psychosocial, health and legal issues. The interests of the child conceived are paramount and people receiving donated gametes are encouraged to tell any children conceived of the donor’s contribution.
In New Zealand under the Human Assisted Reproductive Technologies Act 2004:
- Donors cannot be paid as it is illegal to buy or sell human eggs and sperm.
- Clinics must notify the Registrar of Births, Deaths and Marriages of the birth of each donor child, along with the identity of the donor.
Under the Status of Children Amendment Act 2004:
- The woman who gives birth is the legal mother and her partner (male or female) is a legal parent with rights of guardianship.
- The donor has no legal rights or responsibilities for the child.
All donors are available to be contacted by the child once it reaches 18 years of age.

Embryo donation, some within family donations, surrogacy, and the use of donated eggs in conjunction with donated sperm require applications to the Ethics Committee on Assisted Reproductive Technology (ECART).
